Official Rules for NBC Action News "3 Degree Warranty" Sweepstakes

Eligibility: Open to legal residents of Kansas or Missouri who are 18 years of age or older. Employees of Scripps Howard Broadcasting Company d/b/a NBC Action News/KSHB-TV, KMCI-TV, Factory Direct, Roth Distribution, or employees of their respective affiliates, advertising, or promotion, security, cleaning, and other leased employee agencies and their immediate families or persons residing in the same household of each are not eligible.
How to Enter and Selection of Winners: To enter the 3 Degree Warranty Sweepstakes, register online at www.nbcactionnews.com or mail a postcard with your name, address and phone number to "3 Degree Warranty", 4720 Oak Street, Kansas City, MO 64112. Then watch NBC Action News at ten each weeknight. Every time NBC Action News Chief Meteorologist Gary Lezak comes within 3 degrees of the day’s high temperature, as officially measured at KCI Airport, he will randomly draw one (1) name from the entries received and place that entry into the quarterly television drawing. On the last weekday of each quarter, depending on the weather, Gary will draw the name of the lucky winner. Odds of becoming a winner are dependent upon number of eligible entries received. KSHB-TV is not responsible for lost, returned or misdirected mail. Only one person per family/household may win per quarter. Limit one entry per household each quarter. In case of multiple entries, only the first entry received will be considered. No purchase is necessary. 3 Degree Warranty Sweepstakes begins February 13, 2008 and ends December 31, 2008. NBC Action News will give a total of four (4) prizes away a year.
Quarterly Prize: There will be one (1) Quarterly Prize Winner, totaling four (4) a year. Each winner will receive one (1) 2,000 gift certificate to Roth Concepts. The A.R.V of the Prize is $2,000. No substitutions or transfers of prizes are permitted. No cash substitutions for prizes.
Notification: Winners will be notified by telephone and/or regular mail. The Grand Prize Winners must complete, sign and return an affidavit of eligibility, liability, and publicity release. Failure to sign and return the affidavit of eligibility and release may result in forfeiture of the Grand Prize. The Grand Prizes will be awarded by random drawing from remaining qualifying winners. By participating in this sweepstakes entrants agree to be bound by these Official Rules and the decision of the judges. Winners agree to waive any and all claims against the Sponsor, its affiliates, employees, agents, and representatives for personal injury or loss that may occur from the participation in this contest or from the receipt or use of any prize, and grant to Sponsor the right to publicize such winner’s name and/or likeness without additional compensation or consideration unless prohibited by law.
Limitations on Liability: By entering, entrant releases and agrees to hold harmless Sponsors and their subsidiaries, affiliate companies, parent companies, suppliers, promotional and advertising companies, and all directors, officers, employees, shareholders, representatives and agents of each of them, from any liability, and waives all causes of action relating to any and all injuries, costs, damages, claims and losses of any kind, including (without limitation) any claims for consequential and incidental damages, attorney's fees, and/or lost revenue, income or profits arising out of (a) participation in the Sweepstakes; (b) the acceptance, delivery, possession, use, misuse and/or enjoyment of the prize(s), including any and all injuries, costs, damages, claims and losses of any kind, relating to death, personal injury or damage to property; and (c) altered, late, lost, damaged, destroyed, inaccurate, defaced, misdirected, mutilated, illegible, stolen, delayed, garbled, misrouted, incomplete entries or human, telephone, computer, online or technical malfunctions (including busy lines and disconnections).

Sponsors are not responsible for typographical, printing or other errors in the offer or administration of this Sweepstakes, including but not limited to errors in advertising, the Official Rules, the selection, notification and announcement of the winner or the distribution of the prizes, nor is Sponsor responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of submissions in the Sweepstakes. Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft of or destruction or unauthorized access to, or alteration of, entries. Sponsors are not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, hardware/software, players or browsers, failure of email or entrants due to or resulting from technical problems or traffic congestion on the Internet or at any web site or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in this Sweepstakes.

If for any reason the Sweepstakes is not capable of running as planned for any reason, including due to: (a) computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes; or (b) earthquake, flood, fire, storm or other natural disaster, act of God, labor controversy or threat thereof, civil disturbance or commotion, disruption of the public markets, war or armed conflict (whether or not officially declared) the Sponsor reserves the right at its sole discretion to cancel, terminate, or suspend the Sweepstakes without obligation or prior notice and in such event to determine the winner via random drawing from among all eligible entries received up to the time of such cancellation, termination or suspension.
Conduct: Sponsors reserve the right at their sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to otherwise be acting in violation of the Official Rules. Sponsors reserve the right to disqualify an entrant whose eligibility is in question or who has been disqualified or is otherwise ineligible to enter. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY ALTER OR DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
Governing Law: The laws of the State of Missouri shall govern the interpretation of these Official Rules. Should there be a conflict between the laws of the State of Missouri and any other laws, the conflict will be resolved in favor of the laws of the State of Missouri.
General Conditions: Scripps Howard Broadcasting d/b/a KSHB-TV, Factory Direct, and Roth Distribution "(Sponsors)", are not responsible for printing or typographical errors in any sweepstakes-related materials; stolen, late, loss, garbled, delayed, misdirected, damaged, incomplete, postage due or illegible entries. Sponsors and any telephone network or Internet service providers are not responsible for incorrect, inaccurate transcription or loss of entry information for any reason whatsoever. If, in the Sponsor’s exclusive judgment, this promotion becomes compromised in any way, Sponsors reserve the right to withdraw the promotion offer, cancel any method of entry, void any entries submitted fraudulently, or select winners from all eligible entries received prior to the act that compromised the promotion. By entering, entrants acknowledge compliance with these official rules including all eligibility requirements. Any attempt to deliberately damage the content or operation of this sweepstakes is unlawful and subject to legal action by the Sponsor or its agents. The judges reserve the right to verify eligibility qualifications of winners and to disqualify any individual they find to be acting in violation of the Official Rules. Decisions of Sponsors are final. In case of multiple entries, only the first entry received will be considered. The retail value of the Grand Prize is $1,000. The winner(s) will be responsible for any applicable taxes.
