TOPEKA, Kan. – A federal grand jury indicted a 26-year-old Kansas City, Kansas man following a shootout with the FBI outside an Olathe Subway shop.

Nicholas Henry is charged with one count of unlawful possession of a firearm after a felony conviction.

Federal authorities accuse Henry of trying to evade arrest by firing a handgun at members of the FBI’s Violent Crimes Task Force on Nov 1.

Henry was wounded during an exchange in a parking lot near 151st and Ridgeview Road in Olathe.

Henry was not allowed to have a gun due to previous felony convictions. He faces up to 10 years in prison and up to $250,000 in fines.
