OLATHE, Kan. – The subject of an NBC Action News Investigation has been sentenced to three years probation for two sexual attacks on female patients at an Overland Park hospital.
Shawn Garbin, 35, was sentenced Thursday in Johnson County District Court for one count of aggravated sexual battery. He will have to serve 32 months in jail if he fails probation. Garbin must also register as a sexual offender.
Garbin previously pleaded guilty to the two separate attacks in December 2007 while working at Shawnee Mission Medical Center.
The NBC Action News Investigators recovered records from the Kansas Nursing Board which showed Garbin attempted to unbuckle a patient's belt, unsnap and unzip her pants. He hugged the patient, kissed and even fondled her breasts.
The next day, Garbin had sexual contact with a different patient. In graphic details, the records state Garbin placed his genitals in the patient's mouth. He admitted to doing the act but said it was consensual.
A Shawnee Mission Medical Center spokesperson said each employee goes through an extensive background check. The hospital fired Garbin after doing an internal investigation. He also lost his nursing license.
The Kansas Board of Nursing decides which nurses can be licensed to work around patients.
The NBC Action News Investigation uncovered dozens of nurses disciplined by the board for a variety of criminal acts. Many of those nurses were still allowed to keep their licenses and work around patients.
